A Ask periodically for a copy of your credit report. Your credit report should list all bank and financial accounts under your name, and will provide other indications of whether someone has wrongfully opened or used any accounts in your name. M Maintain careful records
of your banking and financial accounts. Even though financial
institutions are required to maintain copies of your checks,
debit transactions, and similar transactions for five years,
you should retain your monthly statements and checks for at least
one year, if not more. If you need to dispute a particular check
or transaction; especially if they purport to bear your signatures;
your original records will be more immediately accessible and
useful to the institutions that you have contacted.
You Are Asking . . .
. A franchise agreement would
be considered a general intangible under N.D.C.C. § 41-09-02(1)(rr).
This statute provides that "General intangible" means
any personal property, including things in action, other than
accounts, certificates of deposit, chattel paper, commercial
tort claims, deposit accounts, documents, goods, instruments,
investment property, letter-of-credit rights, letters of credit,
money, and oil, gas, or other minerals before A. A franchise agreement is a contract under which a franchisee is granted the right to engage in the business of offering, selling, or distributing goods or services under a marketing plan dictated in substantial part by a franchiser. As you know, the franchisee is required to pay, directly or indirectly, a franchise fee for this right. Not only the nature of the collateral, but a simple process of elimination tells us that a franchise agreement would be "any personal property" under the definition of general intangible. A "general intangible" is basically the residual category of personal property that is not included in the other defined types of collateral. |
